Snowed last night - streets are shit. Driving? No problem, not a single moment of issue.

Crossing the street to get into my office building? There's a disguised fucking pothole that I step in, and slam down on the pavement on hands and knees. Sigh. Slush in my kick ass knee high boots, wet leggings, have to clean up my dress from slush... and finally after work went to urgent care. Sprained ankle, swollen knee. Fuck this shit.

Sounds like a premises liability issue.

For a city-maintained road? I mean, maybe, but good luck.

Over here, statutory immunity does not apply to known potholes that a political subdivision elects to ignore.

Samesies! Immunity doesn't attach! Of course, proving the elements such that strict liability comes into play is, to quote Blackstone, "a bitch and a half."

It’s not strict liability here, but the path to victory is straight forward. You file a public records request for all pothole complaints for the past five years, and then put together a pattern of negligence.

                      Not difficult.

Of course, the goal is to make sure that the victim is made whole. Be reasonable, you win. Be a bitch, fryers like me come to cook you.

Forced myself to go out today because I spent most of yesterday in bed because of leg pain. Most of today in bed because of leg pain. So I went out, got my free mini facial (Origins stores do these sometimes; check it out). Went to Joanns to get the skeins of thread I need (40% off your entire purchase coupon today/tomorrow).

But my legs hurt so bad the entire time. I'm sitting in my car after Joanns trying not to cry and work up the strength to drive home. It's after 7 and I haven't even eaten today because I haven't had the strength to cook. I shouldn't spend more to eat out but I know when I get home I'm only gonna curl up on the couch under the heating blanket.

'Strict liability' means that you don't have to prove they intended to do something. Just that they did it. Usually, you have to prove that they both did a thing and were aware that they were doing a thing.

Strict liability tends to be used for things like -- speeding, seat belt violations, etc. You don't have to prove that they knowingly or recklessly acted. Just that they did a thing.

I bought a new scale that communicates with my fitbit. Yanked my fitbit out. Researched how to wear it if you can't wear it on your wrist (sanitation issue at work). Restarted my gym membership. Food prepped for the week. Started therapy a few weeks ago (so many tears). Got the recommended books. Started cleaning out my depressed mess of a life (like literally, I have been doing nothing and wallowing in it).

Told my sister, "Hey I'm gonna do this." Got back, "I'm skeptical".

Thought on that a bit. Decided to do it anyways. Still researching my exercise and eating plan. But at least I'm making strides to get back to healthy?

Squat. Deadlift. Bench press/overhead press, alternating. At a reasonable enough weight that you can do three sets of five before you feel like you're gonna die without them actually falling on you.

                                            This right here.

Let’s all do this with you. Everything is a victory. We don’t agree on much, but we all agree to help anyone who is looking for a positive change.

My update: I shed 30 pounds since May 2018. Loved it and am loving it. Getting back into keto+exercise mode is tough in the new house, but at least the weight is staying off.
