    • RE: Critters!

I have stopped going to my own PT because it was far too expensive and just do the exercises at home.

However, our elderly dog fell down our stairs twice yesterday, so I've gone and scheduled physical therapy for him.

It's official. I have turned into my mother, the crazy dog lady.

You know, a lot of ERISA violations can result in awards of attorney’s fees, so many attorneys take such cases on contingent upon such awards or on a contingency fee. So you could look one up, and work it out.

      Worth a shot.

That.... is really good to know.

Because thus far by my count, they've:

      1. Violated ERISA protections by transferring the money from a 401k into an IRA without written spousal consent, which I can't even do with a 403b I've had five times as long as we've been married
      2. Violated fiduciary responsibilities by transferring the money to a custodian with some of the highest fees and poorest service in the industry
      3. Enacted a force-out prior to the time normally allotted, during which the money should've been in a successor plan
      4. Failed to notify us of any this, with the previous plan provider claiming the employer was responsible as the plan sponsor and the employer claiming this was done by the financial company and -- at least as of earlier tonight -- neither party being able to provide us with copies of the written notifications that are required when plan changes are made

And while the HR representative we spoke to is attempting to claim that the company no longer exists and therefore there's no one that can be held responsible for any of this, they're continuing to do business under another name with money from a private investment firm that acquired them and re-formed the business. All without passing through bankruptcy first, so while we all know what happens when one assumes, leaves me with the impression that investors would now be at least partially responsible for any liabilities the company held at acquisition.

@ganymede At the moment I'm considering it because apparently the fuck up with his severance that we thought meant it had expired due to post office delays was actually due to the company pre-dating the paperwork by three months. Between this and the 401k issues....

The trouble is a lawyer would cost more than we'd get, but I really, really, really want to stick it to these assholes.

So, DOL complaint it probably is.

If there is one thing that is super awesome about working for a finance company, it's being able to blurt out the following when dealing with my husband's former employer and the bullshit they pulled with his 401k.

"Yeah, sooooooooo.... the action that you've taken with his account is definitely a violation of ERISA regulations passed all the way back in 1974, the fiduciary obligations you're bound by, and ignores successor plan requirements that would prevent exactly this sort of forceout, not to mention the failure to even notify us of any of this. Will you be sending over the paperwork needed to correct this and transfer the funds to our custodian of choice or should I begin our written complaint to the Department of Labor now?"

@mietze So I know that we don't really know each other or anything but....

Pretty much my entire family in Ohio got COVID just a few short months after losing my aunt unexpectedly. Adults, teenagers, even the kiddos -- including the 18 month old. It was terrible and frightening and I'm sorry you're going through this.

If there's anything some internet rando on the other side of the country can do, let me know.

Hello, I am new player! You are good org leader, set me up with bunch of stuff.

Come play in my org and I will set you up with RP connections to plots, equipment, and cash.

When you buy one of those handy pre-portioned bags of broccoli and cauliflower for that bean salad you like to make, get it home, and notice it expired a month before you bought the goddamn thing.

      1. Ew.

      2. Definitely go back to the store and bitch about that. I've done that before with milk that went sour several days before the printed expiration date because that told me that their food storage practices - whether in shipping or in store - were unsafe and could make people super sick.

That was an issue before the pandemic. Doubt it has gone anywhere.

Remember, folks! Minimum wage is your employer saying "If I could legally pay you less than this, I would."

I am also in the "I don't like the art style train.". I have passed over so many good western shows and anime. I will turn away a webcomic for the same reason.

Same. As a general rule, I much prefer live-action shows and movies to anything animated and while I do definitely watch some animated shows, an art style that I find visually jarring usually gets added to the "one less reason to watch this" pile.

Usually those exceptions are made for things done with CG or things with very high production values and I suspect that it's for the same reason I have difficulty playing first-person video games and struggle with 3D movies. It fucks with my depth perception in a way that makes it difficult for me to process what's happening spatially and I can only look at something like that for so long before it becomes overwhelming at best or actually gives me a headache at worst.

The same thing happens with my taste in fine art. I can sit and stare at a Caravaggio for an hour because I find the perspective fascinating. Plunk me down in front of a 13th century icon and my brain starts breaking it down into shapes that stop making a coherent whole pretty quickly.

I would hold off on that strategy. When I was in college and grad school, that was still a thing, but it was dying out. Now hitting on people at a bar is considered creepy.

Someone please send this memo to the men who have hit on me while I'm on public transit, wearing headphones and visibly doing schoolwork.

Sums it up nicely. It's mostly a cultural thing in the states around the Rockies from what I gather. You aggressively pursue outdoor hobbies every waking hour that you're not at work and...pretty much nothing else. Day drink, I guess. 😂

That word alone makes me hate these people on your behalf. Carry on peeving, sir. Carry on.

Probably nothing, like how Blue Lives Matter has nothing to do with actually supporting law enforcement.

Ohh, god. Blue Lives Matter is so, so weird where we live.

See, I live in a mostly black, formerly mostly Jewish neighborhood.

I also live in a neighborhood where, because of regulations requiring city employees to live within the city limits, we have a large number of emergency responders and their families living here.

Specifically because of the overlap, we have a significant number of black cops who live in my neighborhood. Like, I can think of at least four just on my block, and those are from the slim percentage of neighbors I bother talking to.

It's.... it's weird. It's weird, and complicated, and and just.... unnnnnngh.

Something about rock climbing, I’d wager.

That's what I would assume, but I don't know what that has to do with being married and poly.
